Release and Indemnity:
I participate in the activity at my sole risk and responsibility. I release, indemnify and hold
harmless Fit & Functional, Inc. Studio, its servants and agents, from and against all and any
actions or claims which may be made by me or o my behalf or by other parties for or in respect
of or arising out of any injury, loss, damage, or death caused to me or my property whether by
negligence, breach of contract or in any way whatsoever.
Payments:
SHOULD YOU (THE BUYER) CHOOSE TO PAY FOR MORE THAN ONE (1) MONTH OF THIS
AGREEMENT IN ADVANCE, BE AWARE THAT YOU ARE PAYING FOR FUTURE SERVICES
AND MAY BE RISKING LOSS OF YOUR MONEY IN THE EVENT THIS HEALTH STUDIO AND/
OR THIS BUSINESS LOCATION CEASES TO OPERATE. THIS HEALTH STUDIO IS NOT
REQUIRED BY FLORIDA LAW TO PROVIDE ANY SECURITY, AND THERE MAY NOT BE
OTHER PROTECTIONS PROVIDED TO YOU SHOULD YOU CHOOSE TO PAY IN ADVANCE.
Cancellations, Suspensions & Refunds:
The contract provides for the penalty-free cancellation of the contract within 3 days, exclusive
of holidays and weekends, of its making, upon the mailing or delivery written notice to Fit &
Functional, Inc. Studio, and refund upon such notice of all monies paid under the contract,
except that Fit & Functional, Inc. Studio may retain an amount computed by dividing the
number of occasions Fit & Functional, Inc. Studio are to be rendered into he total contract price
and by multiplying the result by the number of complete days that have passed since the
making of the contract, or if appropriate by the number of occasions that Fit & Functional, Inc.
Studio services have been rendered. A refund shall be issued thirty (30) days after receipt of
the notice of cancellation. Any request to cancel thereafter will only be permitted by relocation
of the member of a distance of more than 5 miles away from Fit & Functional, Inc Studio, onset
of a medical condition or injury that prevents you from safely participating in a health and
fitness program, or death of the member. Written documentation confirming said terms for
cancellation must be provided in order to qualify for membership termination. ______(member
initial) In the event of Fit & Functional, Inc. Studio going out of business, or moving its facility
more than five driving miles from the business location designated in this agreement, Fit &
Functional, Inc. Studio will give at least a 30 day notice to clients and provide facility options to
clients that are within five (5) driving miles of location in current agreement at no additional cost
to client. If these requirements are not met a cancellation and refund will be due to the buyer.
Any notice of intent to cancel services by client shall be given in writing to Fit & Functional, Inc.
Studio. Such a notice of cancellation from the client shall also terminate automatically the
clients obligation to any entity to whom Fit & Functional, Inc. Studio has subrogate or assigned
the clients agreement. If Fit & Functional, Inc. Studio wishes to enforce the contract after this
notice, it may request the department to determine a sufficiency notice.
Membership may be suspended for a minimum term of one month and a maximum term of 6
moths. A member must specify a start and finish date. Early reactivation is permissible. To
suspend a membership, the member must complete a suspension form and lodge it to Fit &
Functional, Inc. Studio prior to the commencement of their suspension.
